The Legal Battle Between Lamar Jackson and Troy Aikman
Lamar Jackson, quarterback for the Baltimore Ravens, and Troy Aikman, Dallas Cowboys legend and NFL Hall of Famer, are in a dispute before the United States Patent and Trademark Office over the trademark use of the number "8."
"Jackson has spent a lot of time, effort, and money promoting, advertising, and popularizing the number 8 in relation to his personality and fame. He is well-known for this number due to his notoriety along with his promotion of this number in his trademarks and media coverage," stated the Ravens quarterback's attorney.
Since joining the NFL, 27-year-old Lamar Jackson, MVP of the 2019 and 2023 seasons, has worn the number 8 on his jersey.
He has capitalized on his popularity by commercializing his brand "Era 8," through which he sells t-shirts, caps, backpacks, bags, lotions, and other products featuring his image and the distinctive "Era 8."
Jackson filed an opposition with the Patent and Trademark Office over the rights to this number due to Aikman's desire to use the "EIGHT" trademark on clothing and bags, in addition to its use in the beer brand of the same name that the former Cowboys quarterback has had since 2022.
Like Jackson, 57-year-old Troy Aikman wore the number 8 jersey during his 12-season career (1989-2000) with the Dallas Cowboys, a team with which he won three Super Bowls, was MVP in one of them, and set several team and league records that led to his induction into the NFL Hall of Fame.
The argument Lamar and his lawyers used for the opposition is that the name "EIGHT" could cause confusion, lead to mistakes, or deceive consumers about whether they are purchasing products from Jackson or the former Cowboys star's company. Troy Aikman must file his appeal with the Patent and Trademark Office by August 18.
